Terms of Service
Last updated:
These Terms of Service ("Terms") govern your access to and use of yayvid at yayvid.com (the "Service") ("we", "us"). By using the Service you agree to these Terms and to our Privacy Policy and Acceptable Use Policy.
yayvid is operated by TAGLEC USA LLC, 6641 W Belmont Ave, Ste 3 #224, Chicago, IL 60634, USA.
1. Eligibility
You must be at least 13 years old to use the Service. If you use the Service on behalf of an organisation, you confirm you are authorised to accept these Terms for it.
2. Accounts
You are responsible for activity under your account and for keeping access to your email account secure. One person may hold one account.
3. The Service
We may change, suspend or discontinue features at any time. We try to give reasonable notice of material changes that affect paid features.
AI-generated content
The Service uses third-party artificial intelligence models to generate content. Outputs are produced automatically, may be inaccurate, and are labelled as AI-generated. We currently use: fal.ai (fal.ai Inc., USA) (Alibaba Wan 3.0 image-to-video, MiniMax Hailuo H3 image-to-video, Google Nano Banana Pro image edit). Prompts and outputs are screened by automated content filters before generation and before display.
4. Acceptable use
You must follow our Acceptable Use Policy. We may refuse requests, remove content and suspend accounts that violate it.
Images of people
- Only upload a photo if you have permission from everyone shown in it. For anyone under 18, that permission must come from their parent or legal guardian. You confirm this when you pay for a video (or, when you use credits, before it is made), and we record when you did.
- Do not upload or generate content showing people without their consent, or public figures and celebrities.
- Sexual or adult content, content that replaces a real person's face or body with someone else's, and content that impersonates or could be mistaken for a real person's own words or actions are not allowed.
- Every upload, prompt and result is checked by automated moderation before it is used or shown; content that fails a check is refused and its files are deleted.
- The Service creates images and videos from text and still images only; it does not accept videos of people as input.
5. Your content
You keep ownership of content you upload and, to the extent permitted by law and the terms of the underlying model providers, of the outputs generated for you. You grant us a limited licence to host, process and display your content solely to operate the Service. You are responsible for having the rights to anything you upload, including the consent of any person shown in it.
6. Credits
- Credits are a prepaid right to use the Service. They have no cash value and cannot be transferred or exchanged.
- Credits are deducted when a request starts and returned automatically if it fails.
- Credits may expire as stated on the pricing page at the time of purchase or grant.
- Credits bought in a credit pack are valid for 12 months from the purchase; unused credits expire after that.
- Credits that come with a subscription are that billing period's allowance: they are used before any other credits and do not carry over — what is left when the plan renews or ends expires.
7. Payments
You buy from us, the seller of the Service. Payments are processed on our behalf by Stripe; we never see or store your full card number. Wallets such as Apple Pay, Google Pay and Link may be offered at checkout, and your bank may ask you to confirm the payment (3D Secure).
The charge appears on your card statement as "YAYVID".
Prices are shown at checkout, including any sales tax or VAT we are required to charge where you live. You are responsible for any other taxes, bank or currency conversion fees charged by your card issuer.
Subscriptions and recurring charges
By starting a subscription you authorise recurring charges at the price and interval shown at checkout until you cancel. You can cancel at any time from the Billing section of your account page ("Manage subscription"); cancellation takes effect at the end of the current billing period and you keep access until then. Credits included with a subscription are granted at the start of each paid period.
We send a receipt for every charge and an email 3 days before each renewal with the amount, the date and a link to cancel. If a renewal payment fails we retry it automatically and email you to update your payment method; if it keeps failing the subscription is cancelled. Upgrading to a bigger plan takes effect at once (you pay the prorated difference and get the extra credits right away); a smaller plan takes effect at the next renewal. We will tell you in advance about any price change, and you can cancel before it applies.
Right of withdrawal (EEA, UK and Switzerland)
Credits, subscriptions and videos are digital content and services we start providing immediately after payment. If you are a consumer in the European Economic Area, the United Kingdom or Switzerland, you agree at checkout that we start at once and acknowledge that you thereby lose your 14-day right of withdrawal. Our Refund Policy still applies.
Refunds
Refunds are handled under our Refund Policy. If a payment is refunded or reversed, the credits it granted are removed from your balance.
Disputed charges
If you do not recognise a charge or think it is wrong, please contact us first — use "Request refund" on your account page or email support@yayvid.com. If a legitimate charge is disputed with your bank, the credits it granted are removed and the account may be suspended while the dispute is open; we may share records of the purchase and of your use of the Service (such as generation and download times) with the payment processor and your bank to respond to the dispute.
8. Termination
You may stop using the Service at any time and delete your account from your account page. We may suspend or terminate access for violations of these Terms or to protect the Service or other users.
9. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law.
10. Limitation of liability
To the fullest extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential losses. Nothing in these Terms limits liability that cannot be limited by law.
11. Governing law
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules.
12. Changes
We may update these Terms. The date at the top shows the latest version. Material changes will be announced on the Service before they take effect.
